MEMORANDUM IN THE ACTION OF SEPARATION AND ALIMENT BY ERS JANE ROSS NEW ZEALAND AGAINST JOHN ROSS HOY DECEASED
The late John Ross was a native of Invergordan in the County of Ross and Cromarty. After serving as an apprentice to a Blacksmith, he enlisted in the Army and on his discharge therefrom was appointed an Overseer in the Public Water Works at Hong Kong in September 1893.
In April 1902 the deceased left Hong Kong on
holiday and returned to this country.
On 4th June 1902 he married the said Jane Ross, who was a cousin of his, and who had for some time prior thereto been Housekeeper to a Mr. Dempster, a farmer at Glastullich near Tain. The said Jane Ross had in December 1891 given birth to an illegitimate male child. At the times of the procreation and birth of said child, the deceased was serving with the 25th Company of Royal Engineers of Hong Kong.
The conduct of the said Jane Rose after the marriage was, as will be sean from deceased's precognition very unsatisfactory and more than questionable.
The deceased and his wife the said Jane Ross arrived in Hong Kong in February 1903, and he resumed duty on 1st March,
The conduct of the said Jane Ross in Hong Kong was such that about July 1904 he sent her to Scotland. There she remained (along with her illegitimate child and a boy named Frederick Thomson who had been adopted by the deceased in Hong Kong, and whom he had taken to Scotland when on holiday and left there) for about a year. About August 1905 the said Jane Ross went back to Hong Kong taking with her the said two children.
At first her behaviour was all right, but ere long her conduct again became unsatisfactory with the
